Status of an Appeal

Find out what's happening with your WCAT appeal by entering your WorkSafeBC claim number.

  • You do not need to include the letters which precede the WorkSafeBC claim number.
  • You will be able to use this tool to check on the status of your appeal, except for discriminatory action, prevention and assessment appeals.
  • This can only be searched by WorkSafeBC claim number (example 12345678, UC12345678), but not by an appeal number (example A16XXXXX).

A WCAT appeal passes through several stages:

1. WCAT Notified of Intention to Appeal  more ...

WCAT knows that an appellant wants to start an appeal. We must ensure that the appeal meets a number of preliminary requirements. Some examples are:

  • Whether the notice of appeal form is complete;
  • Whether we received the appeal late and, if we did, whether there were special circumstances that prevented the appellant from appealing within the time limit;
  • Whether we have the power to decide the appeal.

2. Appeal Proceeding  more ...

WCAT considers all the preliminary requirements for starting an appeal have been met. We invite directly affected parties to participate in the appeal. We are waiting for the Notice of Participation from the respondent and order WorkSafeBC to disclose their files to the parties participating in the appeal. If we received a stay application, we will decide it. We will also determine how the appeal will proceed.

3. Written Submission Process  more ...

We will make a decision on the appeal on the basis of written submissions. We have invited or will be inviting the participating parties to provide submissions or we have received written submissions from the participating parties.

4. Oral Hearing Process  more ...

We will make a decision on the appeal after an oral hearing. The appeal is waiting for us to schedule the oral hearing or we have scheduled the oral hearing. We schedule oral hearings according to the date we received the completed appeal form.

We will normally give parties at least four weeks' notice of the oral hearing date. We will automatically grant a request to change the oral hearing date within 14 days of the oral hearing notice. After that, we will only grant a change request in exceptional circumstances.

If the oral hearing has been scheduled, we have contacted or will be contacting the participating parties about the hearing. The date of the hearing shows on the status search results.

5. With Panel for Decision  more ...

The appeal is with the vice chair for decision.

6. Decided  more ...

WCAT has decided the appeal and the vice chair has issued a written decision which we have mailed to the parties and to WorkSafeBC. Possible appeal outcomes are vary, confirm and cancel.

7. Suspended  more ...

WCAT has suspended the appeal for one of several reasons:

  • Suspended 251 - because the vice chair considers that a WorkSafeBC policy should not be applied;
  • Suspended 246(3) - because the vice chair referred an undetermined matter back to WorkSafeBC to determine;
  • Suspended 252 - because a WorkSafeBC decision on a related matter is pending;
  • Suspended IHP - because the vice chair is obtaining advice from an independent health professional.

8. Closed by Summary Decision  more ...

WCAT has closed or dismissed the appeal without making a decision on the merits for one of several reasons. This may happen at any stage of the appeal.

Some examples of summary decisions are:

  • The appeal was late and we denied the application for extension of time;
  • The subject matter of the appeal was not within our jurisdiction;
  • We were unable to contact the appellant;
  • The appellant withdrew the appeal.
